Introduction

These Terms of Service ("Terms") are a binding agreement between you ("you", "user") and White Colony Kft., a company registered in Hungary under company registration number 07-09-457208, with its registered address at 1132 Budapest, Váci út 16. Fsz. 12. ajtó, Hungary ("Company", "we", "us").

The Terms govern your use of the browser game Throne of Dust, the website throneofdustgame.com, and the game service at play.throneofdustgame.com, together with all related accounts, payment and payout flows, the Relic Market, in-game features, digital content, and support services (the "Platform").

By creating an account, playing the game, purchasing digital content, or using the Relic Market, you confirm that you have read and accepted these Terms. If you do not accept them, do not use the Platform.

1. Definitions

(a) "Silver" — the in-game currency earned through gameplay. Silver cannot be purchased for real money and cannot be withdrawn, refunded, or converted into real money.

(b) "Gold" — the premium in-game currency. Gold may be purchased for real money and spent within the game on equipment, consumables, masks, repairs, and other features. Gold cannot be withdrawn or converted into real money.

(c) "Aurum" (displayed in the game as "Aurum Bars") — the Platform balance used on the Relic Market. Aurum may be purchased for real money or received as proceeds from selling Relics on the Relic Market.

(c1) "Market Aurum" — Aurum credited to your account as proceeds from a completed sale of a Relic to another user on the Relic Market. Only Market Aurum may be eligible for payout under Section 11. Purchased Aurum, bonus Aurum, promotional Aurum, and Aurum obtained in any other way are not eligible for payout.

(d) "Gold Purchase Rate" — the rate at which Gold is sold by the Company. Unless otherwise displayed at checkout, the Gold Purchase Rate is 1 EUR = 10 Gold.

(e) "Aurum Purchase Rate" — the rate at which Aurum is sold by the Company. Unless otherwise displayed at checkout, the Aurum Purchase Rate is 1 Aurum = 1 EUR.

(f) "Aurum Payout Rate" — the rate at which eligible Market Aurum may be converted back to real money through the payout function. Unless otherwise displayed at the time of the payout request, the Aurum Payout Rate is 1 Aurum = 0.50 EUR.

(g) "Relics" — rare Virtual Items obtained through gameplay that may be traded between users on the Relic Market.

(h) "Relic Market" — the in-Platform market on which users may list, buy, and sell eligible Relics with each other for Aurum.

(i) "Virtual Items" — any in-game content: equipment, weapons, armour, masks, consumables, Relics, ranks, account features, and other in-game objects or entitlements.

(j) "Digital Content" — Virtual Items, Silver, Gold, Aurum, and any other digital material supplied through the Platform.

(k) "Consumer" — a natural person acting outside their trade, business, or profession.

(l) "Commission" — any fee retained by the Company on a purchase, market transaction, payout, or other transaction, as displayed on the Platform or described in these Terms.

(m) "Services" — the game, the website, accounts, purchases, the Relic Market, payouts, support, and all related services provided by the Company.

3. Our Services

Throne of Dust is a browser-based dark desert fantasy tactical duel RPG. The game includes PvE battles against a fixed sequence of enemies, a ranked arena with leagues, equipment tiers, masks, consumables, Relics, the Relic Market, and the virtual currencies Silver, Gold, and Aurum.

All rights in the game and the Platform — software, artwork, design, characters, texts, game systems, databases, and trademarks — belong to the Company or its licensors. Using the Services does not transfer ownership of the game, any Virtual Item, or any balance to you.

Provided you comply with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Platform for personal entertainment.

As a live game in active development, we may add, change, rebalance, restrict, or remove features, items, currencies, prices in virtual currency, drop rates, enemies, equipment tiers, leagues, market rules, and other elements of the Services, subject to applicable consumer law.

4. Eligibility and Age Requirement

The Platform is intended only for users who are at least 18 years old. By using the Platform you confirm that you are 18 or older and have the legal capacity to enter into this agreement.

You may not use the Platform where doing so is unlawful in your jurisdiction. We may restrict access in countries or territories where operating the Platform would be prohibited or would require licences or compliance measures we do not maintain, and we may use geolocation, payment screening, and verification tools to enforce this.

5. Account Registration and Security

An account is required to play. You agree to provide accurate information at registration and keep it up to date.

You are responsible for the confidentiality of your credentials and for all activity under your account. Accounts are personal: you may not share, sell, rent, or transfer your account. Notify us immediately at support@throneofdustgame.com if you suspect unauthorised access.

We may restrict or suspend an account we reasonably believe is compromised or involved in fraud, abuse, chargeback misuse, market manipulation, automation, or other breaches of these Terms.

6. Virtual Items and Digital Content

Virtual Items and Digital Content are licensed for use within the Platform, not sold to you as property. You acquire no ownership, property, or intellectual-property rights in them and no right to use them outside the Platform.

Virtual Items may be obtained through gameplay, purchases, the Relic Market, or promotions. Their availability, characteristics, rarity, drop rates, and prices in virtual currency may change over time as part of game development and balancing.

Virtual Items, Silver, Gold, and Aurum may not be sold, traded, gifted, or transferred outside the Platform. Off-Platform transactions are prohibited and may lead to suspension, forfeiture of the content involved, and refusal of payouts.

7. Silver

Silver is earned through gameplay and spent only within the game, for example on starter equipment and basic consumables. Where the game offers it, Silver may be exchanged for Gold at the rate displayed in the game.

Silver has no monetary value. It is not legal tender, not electronic money, not a financial instrument, and cannot be purchased for, redeemed for, or converted into real money. Silver cannot be submitted for payout or refund.

8. Gold

Gold is the premium in-game currency. Gold may be purchased in the game through the Top Up window, at the prices displayed on the purchase screen.

Gold may be spent within the game — including on tiered equipment, consumables, masks, and repairs. Once Gold is spent or otherwise consumed, it is treated as consumed Digital Content and is not refundable except where the law requires otherwise.

Gold has no monetary value outside the Platform. It is not legal tender, not electronic money, not a deposit, and not a financial instrument. Gold cannot be submitted for payout or converted into real money.

If you purchase Gold and request immediate delivery, you acknowledge that you may lose your statutory right of withdrawal once delivery begins (see Section 18).

9. Aurum

Aurum is the Platform balance used on the Relic Market. Aurum may be purchased in the game through the Top Up window, at the prices displayed on the purchase screen, and is also credited to sellers as proceeds from completed Relic Market sales.

Aurum may be spent within the Platform on Relics listed by other users. Aurum is not legal tender, not electronic money, not a deposit, and not a security, crypto-asset, or investment product, and carries no right to interest or appreciation. The Platform does not guarantee demand for Relics, market sales, or any financial outcome from playing.

We distinguish categories of Aurum — including purchased, bonus, promotional, Market, pending, locked, and disputed Aurum. Only Market Aurum marked by the Platform as eligible may be submitted for payout under Section 11; all other categories of Aurum, including purchased Aurum, may be spent within the Platform but cannot be converted to real money. Aurum connected to fraud, chargebacks, technical errors, promotional grants, market manipulation, or suspected unlawful conduct may be frozen, reversed, or made ineligible.

If you purchase Aurum and request immediate delivery, you acknowledge that you may lose your statutory right of withdrawal once delivery begins (see Section 18).

10. Relic Market

The Relic Market allows users to list, buy, and sell eligible Relics with each other for Aurum.

When you list a Relic, you set the price within the price range allowed by the Platform. When another user buys the item, the purchase price in Aurum is credited to you as Market Aurum, less any Commission displayed before the transaction is confirmed. The Company provides the listing and matching function; it is not a party to the sale between users.

The Relic Market is not an exchange, a financial market, a payment service, a broker, or a gambling service. Completed market transactions are final, except that we may reverse, cancel, or freeze a transaction caused by fraud, technical error, chargeback, unauthorised access, automation, market manipulation, or a breach of these Terms.

You must not manipulate prices, create artificial demand, trade between your own accounts, conduct wash trades, collude with other users, or use the Relic Market to transfer value in breach of these Terms.

11. Payout (Reverse Conversion of Eligible Market Aurum)

The Platform offers a payout function through which eligible Market Aurum can be converted back to real money and paid to a bank card.

(a) What can be paid out. Only Market Aurum marked by the Platform as eligible may be submitted. Gold, Silver, purchased Aurum, bonus Aurum, and promotional Aurum can never be paid out.

(b) Rate, currencies, and minimum. Unless otherwise displayed in the payout flow, the Aurum Payout Rate is 1 Aurum = 0.50 EUR. Payouts are available in EUR or USD; USD amounts are calculated at the exchange rate shown in the withdrawal form. The minimum payout is 50 Aurum (25.00 EUR). We charge no Commission on payouts. Fees charged by your bank or card issuer, if any, are outside our control.

(c) Request. You submit a request in the Withdraw tab by choosing the currency and the amount. The requested Aurum is immediately deducted from your balance and held for this request, and the request appears in your payout history with the status "Awaiting review". Held Aurum cannot be spent while the request is pending, and the same request cannot be paid twice.

(d) Review and approval. Each request is reviewed individually by an administrator from a separate administrator account. Review includes payout-eligibility checks, fraud checks, and sanctions screening. We aim to review requests within 3 business days. A request is then approved or declined in accordance with these Terms.

(e) Card details. After approval, the request moves to the status "Approved", and the payout is completed by you: you enter the Visa or Mastercard number to which the payment should be sent and the cardholder name. No CVC or expiry date is requested. By submitting the form, you confirm that the card belongs to you. Administrators never see your full card number.

(f) One-time use of card data. Your full card number is used once to send the payment and is never stored. Payout records keep only a masked number (the first six and last four digits) and the cardholder name. See the Privacy Policy for details.

(g) Settlement. Once the payment is sent, the request moves to "Processing" and then to "Paid". Funds typically arrive within 1–3 business days, depending on the receiving bank. You can follow every request in the Withdraw tab and in Settings → Payouts.

(h) Returns. If a request is declined or the transfer fails, the held Aurum is automatically returned to your balance in full and the request is marked "Declined" or "Failed", except where the Aurum itself was obtained in breach of these Terms.

The payout function is additionally subject to the following conditions: (a) we may require identity verification and verification of card ownership before approving a payout, and may withhold the payout until verification is completed; (b) we may delay, refuse, or reverse a payout in cases of suspected fraud, abuse of game mechanics, use of multiple accounts, chargeback risk, a disputed or unauthorised payment, technical error, legal or compliance requirements, or unresolved disputes; (c) you are responsible for entering a correct card number, and we are not liable for payments executed as instructed to a card number you entered incorrectly; (d) amounts paid out to you may be taxable income in your country of residence, and you are responsible for declaring any applicable taxes; (e) availability of payouts may depend on your jurisdiction, account history, and applicable law; (f) the payout function may be suspended for maintenance, compliance, or risk reasons; (g) we may change the payout rate, minimum amount, supported currencies, or supported card schemes for future requests, but never for requests already submitted.

Payouts are made by White Colony Kft., 1132 Budapest, Váci út 16. Fsz. 12. ajtó, Hungary.

A payout request is not a refund. Refunds are governed by Section 18 and the Refund and Cancellation Policy.

12. Payments and Pricing

Prices are displayed at checkout in EUR and include taxes where the law requires. Payments are processed by authorised third-party payment providers and may be protected by 3D Secure authentication where supported; by submitting payment details you authorise the applicable charge.

We do not store full card details; payment data is handled by the payment provider under its own terms and privacy notice.

We may refuse, cancel, or reverse a transaction in cases of pricing or technical error, suspected fraud, chargeback risk, compliance concerns, or breach of these Terms.

13. Commissions and Fees

The Platform may charge Commissions or fees on purchases, market transactions, or other transactions. Where a Commission applies, its amount or calculation method will be shown in the relevant flow or in these Terms; confirming the transaction constitutes acceptance of the Commission.

We may update Commissions, fees, and minimum payout limits from time to time. Changes do not affect transactions already completed, except where required by law, payment rules, or fraud handling.

14. Compliance and Sanctions

We may perform identity and payment verification, sanctions screening, transaction monitoring, and other checks required or permitted by law, payment-provider rules, or our risk controls — in particular in connection with the Relic Market and payouts.

You agree to cooperate with reasonable verification requests; failure to do so may result in transaction limits, payout refusal, or account restrictions. You confirm that all funds you use on the Platform come from lawful sources and that your use of the Platform complies with applicable law, including sanctions rules. We may report suspicious activity to competent authorities where required or permitted by law.

15. Acceptable Use

You must not:

(a) use bots, scripts, macros, or other automation to play or gain advantage; (b) exploit bugs, balancing errors, market errors, or payment errors instead of reporting them to support@throneofdustgame.com; (c) manipulate battles, rankings, drops, rewards, market listings, prices, or the payout function; (d) create or use multiple accounts to trade with yourself, abuse promotions, bypass limits, or conceal identity; (e) buy, sell, rent, or trade accounts, Silver, Gold, Aurum, or Virtual Items outside the Platform; (f) harass or threaten other users or submit unlawful, hateful, or fraudulent content; (g) use the Platform for gambling, money laundering, sanctions evasion, or any other unlawful value transfer; (h) reverse-engineer, copy, or interfere with the Platform or the game; (i) use stolen or unauthorised payment methods, or enter card details that you are not authorised to use; (j) attempt to bypass security, verification, regional, or account controls.

16. Suspension, Termination, and Forfeiture

We may restrict, suspend, or terminate your account or access to features if we reasonably believe you have breached these Terms, violated the law, abused game, market, or payment systems, caused chargebacks, or otherwise harmed the Platform or other users.

Upon suspension or termination we may, subject to applicable law, freeze or forfeit Virtual Items, Silver, Gold, Aurum, market listings, pending payout requests, and other account features connected to the breach.

You may request closure of your account at support@throneofdustgame.com. Closure may be delayed while there are pending transactions, market listings, disputes, verification obligations, or legal retention requirements.

17. Delivery of Digital Content

Digital Content is normally credited to your account immediately after payment confirmation, or within a short technical processing period.

If purchased content is not delivered, contact support@throneofdustgame.com — we will investigate and deliver the content, correct the balance, or refund you where the law or the Refund and Cancellation Policy requires.

18. Refunds and Consumer Right of Withdrawal

Refunds are governed by this Section and the Refund and Cancellation Policy published on the Platform.

If you are a Consumer in the EU/EEA, you normally have a 14-day right of withdrawal from a distance contract. For Digital Content, this right is lost where you expressly request immediate delivery and acknowledge the loss of the withdrawal right; the checkout flow will ask for this consent so that Gold, Aurum, and other content can be delivered immediately.

Gold, Aurum, and other Digital Content that have been delivered and then spent, consumed, used in gameplay, listed or traded on the Relic Market, submitted for payout, or otherwise activated are not refundable except where required by applicable law. Entirely unused purchases may be refunded as described in the Refund and Cancellation Policy.

Payout requests under Section 11 are not refunds and do not extend or replace your statutory rights.

19. Intellectual Property

All intellectual property in the Platform and the game — code, artwork, animations, design, texts, lore, characters, enemies, items, sounds, music, databases, balancing, names, and logos — belongs to the Company or its licensors.

You may not copy, modify, distribute, sell, publish, create derivative works from, scrape, or commercially exploit any part of the Platform without our prior written consent, except where mandatory law allows.

20. User Content

Where the Platform lets you submit content (for example a nickname, market listings, profile content, or support messages), you grant us a worldwide, non-exclusive, royalty-free licence to host, display, process, moderate, and remove that content as needed to operate and protect the Platform.

You must not submit content that is unlawful, infringing, abusive, misleading, or otherwise harmful.

21. Third-Party Services

The Platform relies on third-party services such as payment processing, payout processing, hosting, and email delivery, and may contain links to third-party sites. We are not responsible for services we do not control; your use of them is subject to their own terms and privacy notices.

22. Availability and Changes to the Game

The game is provided as a live service in early access and active development. Features may be added, changed, or removed, and maintenance windows may occur. If we permanently discontinue the game, we will give reasonable advance notice on the Platform.

23. Disclaimers

The Platform and Services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, compatibility with every device, or availability in every jurisdiction.

We do not guarantee any gameplay outcome, item drop, ranking, market sale, item value, payout availability, or any financial result. Nothing on the Platform is financial, tax, legal, or other professional advice.

24. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability in connection with the Platform and these Terms is limited to the greater of (i) the amount you paid us in the 12 months before the event giving rise to the claim, or (ii) EUR 100.

To the same extent, we are not liable for indirect, incidental, consequential, or special damages, including loss of data, goodwill, or opportunity, or losses arising from gameplay outcomes, market outcomes, account suspension, or third-party services.

Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protections.

25. Indemnification

To the extent permitted by law, you agree to indemnify the Company and its officers, employees, contractors, and licensors against claims, losses, and costs arising from your breach of these Terms, unlawful conduct, infringement of third-party rights, payment misuse, prohibited market activity, or chargebacks caused by your breach.

26. Changes to These Terms

We may update these Terms. For material changes we will take reasonable steps to notify you through the Platform or by email before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Platform and you may request account closure.

27. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hungary, without prejudice to mandatory consumer protections of your country of residence.

Before starting formal proceedings, both parties agree to attempt to resolve the dispute informally by contacting support@throneofdustgame.com. EU Consumers may also contact the consumer dispute resolution bodies of their country of residence. The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025.

28. General Provisions

(a) Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, Refund and Cancellation Policy, and any additional rules published on the Platform, form the entire agreement between you and the Company regarding the Platform. (b) Severability. If any provision is found invalid, the remaining provisions stay in force. (c) No waiver. Not enforcing a provision does not waive our right to enforce it later. (d) Assignment. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a merger, acquisition, or sale of business. (e) Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including network or payment-provider failures, cyber incidents, governmental actions, or natural disasters. (f) Language. These Terms are drawn up in English; if translated, the English version prevails unless mandatory law provides otherwise.
